Please read these Terms and Conditions ("Terms") carefully before using the Last Gnome Location website (lastgnomelocation.com) and mobile application (the "Service") operated by Last Gnome Location ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you agree to be bound by these Terms. If you do not agree to the Terms, you may not access the Service.
Use of the Service
1.1. Last Gnome Location is an entertainment platform where users can document, share, and explore the journeys of physical gnome figures ("gnomes").
1.2. Gnomes are intended to be personal travel companions. While users are encouraged to explore and share gnome adventures, we do not prescribe how users must interact with their gnome.
1.3. Users are responsible for their own actions while using the Service and while transporting or displaying their gnomes in public or private spaces.
1.4. We are not liable for injuries, damages, or losses incurred during participation in gnome-related activities or use of the Service.
Gnome Ownership
2.1. Physical gnomes distributed by Last Gnome Location, whether purchased or given as part of an event or promotion, become the property of the user.
2.2. We do not guarantee the durability or condition of physical gnomes once in user possession.
User Conduct
3.1. Users agree to interact with the Service lawfully and respectfully, including when placing gnomes in public or private locations.
3.2. Users must not place gnomes in hazardous, restricted, or inappropriate areas.
3.3. We reserve the right to suspend or terminate accounts for any behavior we deem inappropriate or harmful, including violations of these Terms or misuse of community features.
User Content
4.1. Users may upload profile pictures and gnome-related photos to their account through the Service.
4.2. By uploading content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute this content in connection with the Service. This includes potential display on official Last Gnome Location social media channels such as Instagram, unless otherwise limited by your privacy settings.
4.3. We will never sell or license your uploaded content to third parties without your explicit consent.
Email Notifications
5.1. Users may opt in or out of receiving emails related to gnome activity, comment interactions, or marketing updates via their account settings.
5.2. You can change your email notification preferences at any time from the settings page of your account.
Privacy Controls
6.1. The Service includes privacy settings that allow users to control how their content appears to other users. These settings include:
- Whether your profile is visible to other logged-in users.
- Whether your username appears on public leaderboards.
- Whether your comments and gnome locations are visible.
6.2. By default, user activity is public. Users can opt in to make their profile publicly visible to other logged-in users.

Modifications to the Service
7.1. We may modify, update, or discontinue any part of the Service at any time, with or without notice.

8.1. The Service is provided "as is" without warranties of any kind, express or implied.
8.2. We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages related to your use of the Service.
8.3. We are not responsible for the behavior or actions of other users.
Governing Law
9.1. These Terms shall be governed and interpreted in accordance with the laws of the State of Indiana, USA, without regard to conflict of law provisions.
